1. These terms

These Website Terms govern your use of tutsa.co.za and everything on it. By using the site you agree to them. If you do not agree, please do not use the site.

Separate terms apply to particular relationships with us. If you are a parent or guardian engaging a tutor, the Parent and Guardian Terms also apply. If you list a profile, the Tutor Platform Agreement and Subscription Terms also apply. Where there is a conflict, the more specific document wins for that relationship.

2. Who we are

The site is operated by K2022319871 (South Africa), registration number 2022/319871/07, trading as TUTSA, of 21 Montpark Drive, Unit 19 Magalies, Johannesburg, Gauteng, 2190. You can reach us at info@tutsa.co.za. This information is provided in accordance with section 43 of the Electronic Communications and Transactions Act 25 of 2002.

3. What TUTSA is, and what it is not

TUTSA is a discovery and enquiry routing platform. We list independent tutors so that families can find them, and we pass an enquiry to the tutor a family selects.

We do not:

• Employ tutors, or supply tutoring services ourselves
• Set a tutor’s rates, or take a share of what a tutor charges
• Supervise, direct or control how a tutor teaches
• Guarantee academic results, a tutor’s availability, or that a tutor will reply
• Assess, rank or vouch for teaching ability

Verification confirms identity and that qualification documents were seen. It is not an endorsement and it is not an assessment of how well someone teaches.

4. Using the site

Families do not need an account to search or to send an enquiry. Tutors need an account to manage a profile.

You agree not to:

• Use the site for anything unlawful, or in a way that harms others
• Send false, misleading or abusive enquiries, or impersonate anyone
• Harvest, scrape or copy tutor listings or contact details, whether manually or by automated means
• Use contact details obtained through the site for marketing, spam or any purpose other than a genuine tutoring enquiry
• Attempt to gain unauthorised access to the site, or to interfere with its operation or security
• Upload anything containing malicious code

We may suspend or block access where we reasonably believe these terms have been breached.

5. Content on the site

Tutor profiles are written and supplied by the tutors themselves. Rates, availability, subjects and qualifications shown on a profile are that tutor’s representations, not ours. We take reasonable steps to verify identity and qualification documents but we do not independently confirm every claim on every profile.

If something on a profile is inaccurate or misleading, tell us at info@tutsa.co.za and we will look into it.

6. Intellectual property

The TUTSA name, logo, site design, text, graphics and software are owned by us or licensed to us, and are protected by South African and international law. You may view and print pages for your own personal use. You may not copy, republish, adapt or exploit any part of the site commercially without our written permission.

Tutors keep ownership of the content they upload, and grant us a licence as set out in the Tutor Platform Agreement.

7. Links to other sites

The site may link to third party websites. We do not control them and we are not responsible for their content, their products or their privacy practices. A link is not an endorsement.

8. Availability

We try to keep the site available and accurate, but we provide it “as is”. We do not warrant that it will be uninterrupted, error free, or free of viruses. We may change, suspend or withdraw any part of the site at any time.

9. Our liability

Nothing in these terms excludes or limits liability that cannot lawfully be excluded or limited, including liability under the Consumer Protection Act 68 of 2008 where it applies to you.

Subject to that, and to the fullest extent the law allows:

• We are not liable for the acts, omissions, conduct or quality of any tutor, or for anything that happens in a lesson
• We are not liable for indirect or consequential loss, loss of profit, or loss of opportunity
• Where we are found liable to a tutor, our total liability is limited to the membership fees that tutor paid us in the 12 months before the claim arose
• Where we are found liable to a family, and because families pay us nothing, our liability is limited to R1,000

10. Indemnity

You indemnify us against any claim, loss or expense arising from your use of the site in breach of these terms, or from any dispute between you and a tutor or a family.

11. Privacy

How we handle personal information is set out in our Privacy Policy, which forms part of these terms.

12. Changes to these terms

We may update these terms from time to time. The date at the top shows when they were last revised. Continuing to use the site after a change means you accept the revised terms.

13. Governing law and disputes

These terms are governed by the law of the Republic of South Africa. You and we consent to the jurisdiction of the South African courts. Where the Consumer Protection Act applies, nothing here prevents you from referring a dispute to the National Consumer Commission or another forum that Act allows.

Before starting formal proceedings, please raise the matter with us at info@tutsa.co.za so that we can try to resolve it.

14. General

If any part of these terms is found to be unenforceable, the rest continues to apply. Our failure to enforce a right is not a waiver of it. These terms, together with the documents they refer to, are the whole agreement between us about your use of the site.
